Property valuation and distribution issues arise frequently in dissolution of marriage proceedings. Ms. Amado has taken an especial interest in "celebrity goodwill," which is defined as the expectation of continued popularity with its resultant extraordinary earning capacity. Celebrity goodwill has been recognized as an asset in some states, but not in California. Ms. Amado is of the opinion that, while future earning capacity should be considered in establishing support obligations, "celebrity goodwill" should not be classified as an asset, which would essentially force celebrities to "buy back" their reputations and earning capacities. For more information on celebrity goodwill as property, please see Ms. Amado's article "To Have and Have Not." In addition to celebrity goodwill, Ms. Amado has also handled many cases involving the fiduciary duties husbands and wives owe one another during the marriage and throughout separation and the divorcing process until the community assets are distributed. It is well settled that a fiduciary duty exists between marital partners to manage the community assets in the best interests of both parties and to be candid with one another in disclosing all information regarding the existence and value of marital assets. Questions often arise, however, as to the scope of this duty in various situations. More information on marital fiduciary duties may be found in Los Angeles Lawyer magazine.
